All tools and software provided on this website are intended exclusively for research, educational, and informational purposes. They have not been validated for clinical, diagnostic, or therapeutic use and must not be used to make or inform medical decisions.

1. Acceptance of Terms

By accessing or using any tools, software, content, or services (collectively, the "Services") provided on this website by Freesia Labs Inc. ("Freesia," "we," "us," or "our"), you ("User" or "you") agree to be bound by these Terms of Use. If you do not agree to all of these terms, you must not use the Services.

Your use of the BLAST DNA Sequence Search tool or any other tool on this website constitutes your acknowledgement that you have read, understood, and agreed to these Terms of Use, including the Disclaimer of Warranties, Limitation of Liability, and Research Use Only provisions set forth below.

2. Research Use Only

All tools and software provided through this website, including but not limited to the BLAST DNA Sequence Search tool, are provided for research, educational, and informational purposes only.

The Services are NOT intended for and must NOT be used for:

(a) clinical decision-making, clinical diagnosis, or clinical treatment of any kind;
(b) direct or indirect medical decision-making regarding any individual patient or person;
(c) any diagnostic purpose, including but not limited to the diagnosis, prevention, monitoring, prediction, prognosis, treatment, or alleviation of disease;
(d) any purpose that would cause the Services to be classified as a medical device, in vitro diagnostic, or Software as a Medical Device (SaMD) under any applicable regulatory framework including the U.S. FDA, EU MDR/IVDR, or any other jurisdiction's regulations;
(e) any purpose where incorrect or inaccurate results could lead to injury, harm, or death of any person.

The results produced by the Services have not been validated against any clinical reference standard. Sequence alignment results may contain errors, omissions, false positives, false negatives, or inaccurate statistical values. No output of the Services should be interpreted as medical advice, a medical recommendation, or a clinical finding.

3. No Medical Advice

Nothing on this website constitutes medical advice, a medical opinion, or a recommendation for any particular course of medical treatment or non-treatment. The Services do not establish a physician-patient relationship or any similar professional relationship between Freesia and any user.

If you have questions about a medical condition, genetic test results, or any health-related matter, you should consult a qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of information or results obtained through the Services.

4. No Guarantee of Accuracy or Completeness

While we endeavor to provide useful and correctly implemented tools, we make no representation or guarantee that:

(a) the Services are free of bugs, errors, defects, or security vulnerabilities;
(b) the sequence alignment algorithm, scoring, statistical calculations, or any other computational results are correct, complete, or accurate;
(c) the Services will meet your specific requirements or be suitable for your intended purpose;
(d) the Services will operate without interruption or error;
(e) any results produced by the Services are suitable for use in any publication, regulatory submission, patent application, or legal proceeding without independent verification.

You are solely responsible for independently verifying any results obtained through the Services before relying on them for any purpose.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. FREESIA LABS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE, OR TRADE PRACTICE.

WITHOUT LIMITING THE FOREGOING, FREESIA MAKES NO WARRANTY OR REPRESENTATION THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE ALGORITHMS UNDERLYING THEM ARE FREE OF BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM FREESIA OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

6. Limitation of Liability

IN NO EVENT AND UNDER NO LEGAL THEORY, WHETHER IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL FREESIA LABS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, PERSONAL INJURY, BODILY HARM, DEATH, PROPERTY DAMAGE, COMPUTER FAILURE OR MALFUNCTION, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED AND WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FREESIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, FREESIA'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

7. Assumption of Risk

You expressly acknowledge and agree that your use of the Services is at your sole risk. You assume full responsibility for:

(a) determining the appropriateness of using the Services for your intended purpose;
(b) independently verifying all results and outputs before relying on them;
(c) ensuring your use complies with all applicable laws, regulations, and institutional policies, including but not limited to regulations governing the use of bioinformatics tools, genetic data, and health information;
(d) any consequences arising from your reliance on the output of the Services.

8. Indemnification

You agree to indemnify, defend, and hold harmless Freesia Labs Inc., its officers, directors, employees, agents, affiliates, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Services or your violation of these Terms of Use.

9. Data and Privacy

The BLAST DNA Sequence Search tool processes all data locally in your web browser. No sequence data is transmitted to Freesia servers. However, Freesia cannot control or be responsible for:

(a) browser extensions, plugins, or other software on your device that may independently access, read, or transmit page content or data you enter;
(b) the security of your device or network environment;
(c) caching behavior of your browser or operating system.

You are solely responsible for handling sensitive or protected data in accordance with applicable laws and regulations, including but not limited to HIPAA, GDPR, and any other applicable data protection regulations.

10. Intellectual Property

All content, design, code, and other materials on this website are the property of Freesia Labs Inc. or its licensors.

11. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Delaware.

12. Severability

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

13. Modification of Terms

Freesia reserves the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on the Website. Your continued use of the Services after any modification constitutes acceptance of the modified terms. We encourage you to review these Terms periodically.

14. Entire Agreement

These Terms of Use constitute the entire agreement between you and Freesia Labs Inc. with respect to the use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Freesia.
